These Terms of Service (hereinafter called "These Terms") set out the agreement between you and Parceler for the use of our parcel tracking website and iOS application, which we refer to together as the "Service". By accessing or using the Service, you agree to be bound by These Terms. If you do not agree with them, the right thing to do is simply not to use the Service. From time to time we may update These Terms, and continuing to use Parceler after a change means you accept the revised version.
Definitions
A few words mean something specific throughout These Terms:
- "Service"— the Parceler website, iOS application, and any related features we make available.
- "Content"— text, data, tracking results, graphics, and other material that appears in or through the Service.
- "Carrier"— a third-party shipping or logistics provider whose status data we display.
- "You"— the individual or organization using the Service.
What Parceler Is
Parceler gathers shipment status information from third-party carriers and presents it in a single, tidy interface. You can use it without an account for quick one-off lookups, or you can create an account to save and organize the shipments you care about. We work hard to keep tracking results accurate and current, but the underlying data comes from the carriers themselves, so we cannot guarantee that it is always complete or correct.
Eligibility
You need to be at least 13 years old to use Parceler. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to These Terms.
Acceptable Use
We ask that you use Parceler in good faith. You agree not to:
- Track shipments you do not have permission to track.
- Attempt to scrape, reverse engineer, or otherwise interfere with the Service or the carrier integrations that power it.
- Send automated traffic that exceeds normal human use, or build a competing product on top of our data.
- Use the Service for any unlawful purpose or in a way that harms other people who rely on Parceler.
Your Account
If you create an account, you are responsible for keeping your credentials safe and for everything that happens under it. Let us know promptly if you suspect someone has gained access without your permission. We reserve the right to suspend or close accounts that break These Terms.
Intellectual Property
Parceler, our logo, the website, the app, and all the content tied to them are owned by us or by our licensors and are protected by intellectual property law. What you receive is a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. The tracking numbers and shipment data themselves belong to their respective owners and carriers, not to us.
License and Restrictions
Subject to These Terms, we grant you a limited license to access and use the Service for your own personal or internal business purposes. In return, you agree not to copy, modify, distribute, sell, or lease any part of the Service, not to remove any proprietary notices, and not to use the Service to develop a competing product. Any rights not expressly granted to you are reserved by us.
User Content and Feedback
If you send us suggestions, ideas, or other feedback about the Service, you give us the right to use it freely, without obligation to you, to improve Parceler. You keep ownership of anything you submit, but you grant us the permissions we need to operate the Service — for example, to store the shipments you save to your account.
Subscriptions and Fees
Core tracking on Parceler is free. If we offer paid features in the future, the price, billing cycle, and renewal terms will be shown to you beforeyou are charged, and any purchases made through the App Store are also subject to Apple’s terms. Unless the law says otherwise, fees already paid are non-refundable. We will give you reasonable notice before changing the price of a feature you are subscribed to.
Third-Party Carriers
The Service lives or dies on data supplied by third-party shipping carriers. We do not control carrier systems, delivery timelines, or how your parcel is handled along the way. If something goes wrong with the physical shipment, that is a matter to take up with the relevant carrier or with whoever sent the package.
Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error free, or that the tracking data it shows will always be accurate.
Limitation of Liability
To the maximum extent permitted by law, Parceler and its affiliates will not be liable for any indirect, incidental, special, or consequential damages — lost profits, lost data, business interruption, and the like — arising from your use of the Service. Our aggregate liability for any claim connected to the Service will not exceed one hundred US dollars, or the amount you paid us in the twelve months before the claim, whichever happens to be greater.
Indemnification
You agree to defend and hold harmless Parceler and its affiliates from any claims, losses, or expenses — including reasonable legal fees — that arise out of your misuse of the Service, your breach of These Terms, or your violation of the rights of another person. We will let you know promptly of any such claim and may participate in the defense with our own counsel.
Changes to the Service
Parceler is always evolving. We may add, change, or remove features, and we may suspend the Service for maintenance or for reasons outside our control. Where a change is significant, we will try to give you reasonable notice, but we are not obligated to keep any particular feature available forever.
Termination
You are free to stop using the Service whenever you like. For our part, we may suspend or end your access if you breach These Terms, or if keeping the Service running for you would expose us or other users to harm or legal risk. The sections that by their nature ought to outlive the agreement will continue to apply after it ends.
Governing Law
These Terms are governed by the laws of the jurisdiction in which Parceler operates, without regard to its conflict-of-law principles. Any disputes will be settled in the courts of that jurisdiction, unless a different forum is required by applicable consumer protection law. Dispute Resolution
If a dispute arises, we ask that you contact us first so we can try to resolve it informally — most issues can be sorted out with a simple conversation. If that does not work, any unresolved dispute will be handled in the courts identified above, on an individual basis, and you agree not to bring a claim as part of a class or representative action, except where applicable law does not allow such a waiver.
Force Majeure
We are not responsible for failures or delays caused by events beyond our reasonable control — including outages at carriers or cloud providers, natural disasters, strikes, or government action. When such an event passes, we will resume normal service as soon as we reasonably can.
General Terms
If any part of These Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign These Terms without our consent, but we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, make up the entire agreement between you and Parceler regarding the Service.
